Hope Energy Mobile App – Terms & Conditions of Use

These Terms & Conditions (“Terms”) govern your access to and use of the Hope Energy mobile application (the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. Ownership and Operator
The App is published by Hope Energy Pty Ltd (“Hope Energy”, “we”, “us”, “our”).
The App connects with Hope Energy’s point-of-sale and account management systems, operated by our technology partner. Data made available through the App is drawn from these systems.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to use the App. By using the App, you warrant that you meet these requirements.
3. App Functionality
The App allows you to:
- Access account information and transaction history
- Manage your Hope Energy services
- Use features made available from time to time
We may update or modify the App at any time without notice.
4. Data and Privacy
We respect your privacy. Data collected through the App is used only for the purposes of providing, operating, and improving the App.
Your data may be shared with carefully selected third-party service providers strictly to the extent necessary to:
- Operate the App
- Process transactions
- Provide technical support and maintenance

5. Promotions and Rewards
5.1 General
From time to time, Hope Energy may offer promotions, rewards, discounts, loyalty benefits, or other special offers (collectively, “Promotions”) through the App. Each Promotion is subject to these Terms and any additional Promotion Conditions published in the App or otherwise notified to you.
5.2 Eligibility
Unless otherwise specified:
Each Promotion is limited to one (1) redemption per customer.
A “customer” means each unique Hope Energy account holder, household, or individual, as reasonably determined by Hope Energy.
Hope Energy reserves the right to verify eligibility and require proof of identity or purchase.
5.3 Fuel Purchase Requirement
All Promotions must be redeemed in conjunction with a valid fuel purchase at a participating Hope Energy service station. Hope Energy may request proof of purchase (such as a receipt or transaction record) as a condition of redemption.
5.4 Misuse and Fraud
You must not attempt to:
Redeem any Promotion more than once, unless explicitly permitted
Create multiple accounts to access multiple benefits
Provide false or misleading information to obtain benefits
Hope Energy reserves the right to audit, decline, or cancel any Promotion redemption if we suspect non-compliance, misuse, or fraud. We may also suspend or terminate your access to future Promotions or to the App.
5.5 Variation and Withdrawal
Hope Energy may modify, suspend, or withdraw any Promotion at any time without notice, except where prohibited by law. If a Promotion is withdrawn before redemption, Hope Energy may, at its discretion, provide an alternative benefit of equivalent value.
5.6 No Cash Value
Promotions have no monetary value, are non-transferable, and cannot be exchanged for cash or credit unless required by law.
5.7 Limitation of Liability (Promotions)
Except to the extent required by law, Hope Energy and its affiliates are not liable for any loss, damage, or claim arising from participation in or inability to redeem a Promotion, including loss of profit, data, or goodwill. Where liability cannot be excluded, it is limited to the cost of the benefit under the relevant Promotion.
6. No Warranty
The App is provided on an “as is” and “as available” basis. While we take care to ensure accuracy, we make no warranty that:
- The App will be uninterrupted, error-free, or secure
- The data displayed is always up-to-date or complete
7. Limitation of Liability
To the maximum extent permitted by law:
- Hope Energy, its affiliates, and technology partners shall not be liable for any indirect, incidental, or consequential loss, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the App.
- Our liability for any direct loss shall be limited to the re-supply of the App service or the cost of having the App service re-supplied.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
8. User Responsibilities
You agree not to:
- Use the App for unlawful purposes
- Interfere with or disrupt the App or its systems
- Attempt to gain unauthorised access to data or networks
You are responsible for maintaining the confidentiality of your login credentials.
9. Third-Party Services
The App may include links or integrations with third-party services. Hope Energy is not responsible for the content, availability, or performance of these services.
10. Intellectual Property
All intellectual property rights in the App and its content are owned by or licensed to Hope Energy. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for personal use in connection with Hope Energy services.
11. Termination
We may suspend or terminate your access to the App at any time without notice if you breach these Terms or where required by law.
12. Changes to Terms
Hope Energy may update or change these Terms at any time without prior notice. Updated Terms will take effect immediately upon publication in the App or on our website. Your continued use of the App constitutes acceptance of any revised Terms.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.
